This privacy policy (the “Privacy Policy”) applies to the processing of your personal information by the Nouria Rewards mobile application (the “Nouria App”), the Nouria website (https://nouria.com) (this “Website”), the Golden Nozzle website (https://goldennozzlecarwash.com/) (the “Golden Nozzle Website”), and other websites or applications, including those of other affiliates of ours, that link to this Privacy Policy (“Affiliate Websites” and, collectively with the Nouria App, this Website, the Golden Nozzle Website, the “Services”), or through offline business interactions you have at one of our convenience store or car wash locations (each, a “Location” and, collectively, the “Locations”), each operated by Nouria Energy Corporation or our affiliates (“Nouria”, “we,” “us,” or “our”).

For purposes of this Privacy Policy, “personal information” means information relating directly or indirectly to an identifiable individual, as may be further defined in applicable law. We have created this Privacy Policy to tell you what personal information is collected by us, how we use that information, and who we will disclose that information to. This Privacy Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with. By visiting a Location and/or using the Services, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. We encourage you to read the Privacy Policy, and to use the information it contains to help you make informed decisions.

1. PERSONAL INFORMATION WE COLLECT OR RECEIVE
In the course of operating the Services and the Locations, we will collect and/or receive the following types of personal information (collectively, the “Information”) via the following methods of collection of receipt. You authorize us to collect and/or receive such Information.

a. Contact and Demographic Information You Provide to Us or Other Third Parties. We may receive or collect contact and demographic information that identifies you personally if you provide such information to us and/or third-party vendors via the Services, at a Location or by other means (collectively, the “Contact Information”). For example, when you sign up to become a user of the Services, you will be required to provide us and/or our third-party vendors that license the Services to us and administer the Services on our behalf (collectively, our “Services Administrators”) with Contact Information about yourself. Such Contact Information may include your name, e-mail address, physical address, phone number and birth month and day.

b. Purchase and Rewards Information You Provide to Us or Other Third Parties. If you choose to make a fuel, car wash or other purchase, or redeem fuel and other discounts and rewards using the Services, at a Location or through one of our third-party online ordering partners, information about your purchases, rewards, redemptions and other transactions (collectively, “Transactional Information”) will be collected and processed by us pursuant to this Privacy Policy and/or our third-party service providers pursuant to their privacy policies and terms of use. Such Transactional Information may include your name, the last four digits of your payment card number, your purchase and/or reward redemption history, your rewards membership information and any feedback you might have for us.

c. Geolocation Information We Collect Automatically. In order to provide certain features and functionalities in the Services and to provide you with personalized offers, we and our Services Administrators may automatically collect geolocation information from your device or wireless carrier and/or certain third-party service providers (collectively, “Geolocation Information”). For example, we may collect Geolocation Information about you when you use the ”Find a Location” feature in the Services to search for a Location near you. We may also collect information from your device to provide you with personalized offers. Such Geolocation Information may include longitude and latitude from your IP address or mobile device and real-time geographic location information derived from your device.

d. Video, Photograph or Audio Recordings we Create and Collect. Video and/or audio recordings of your likeness and your voice may be collected and used by us in connection with your use of the Services or visit to our Locations. For example, if you visit one of our Locations, your likeness may be recorded in CCTV security video footage or depicted in a photograph for safety and other purposes. If you call our customer service, your conversation may be recorded for training and quality assurance purposes.

e. Information Relating to Incidents Occurring at a Location We Collect or Which You Provide. If there is an incident occurring at one of our Locations, we may collect and use information about you to report the incident and otherwise meet our insurance, legal, regulatory and compliance obligations. For example, we may take photographs of your vehicle license plate and your driver’s license as needed to identify and contact you about the incident and to report the incident with law enforcement authorities.

f. Business Information You Provide. If a company which you are working for is doing business with us, you may provide Information to us so that we can contact you and do business with such company, which may require conducting a credit check to determine creditworthiness (collectively, “B2B Information”). Such B2B Information may include your name and title, your business email and phone number and your social security number or other identification information to conduct a credit check.

g. Recruitment Information You Provide to Us or Other Third Parties. If you apply or are recruited for a job with us, you may provide to us or a third-party personal information about you, which may be provided in your job application, cover letter, or in your communications with us during the recruitment process, or your professional references may provide to us personal information about you (collectively, “Recruitment Information”). Recruitment Information may include the following:

i. Contact information, such as your first and last name, email and mailing addresses, and phone number.

ii. Application information such as qualifications, professional credentials, skills, transcripts, employment or education history, or other information that may be provided in your resume, cover letter, job application or responses to our application or interview questions. This may include diversity, compensation and other non-required information that you voluntarily provide and which may be subject to applicable laws in your location.

iii. Background check information, such as identifying information as necessary for us to conduct a background check, including full name and date of birth, and records obtained from the background check, including criminal records, driving records, employment and education records, financial or credit history, and civil court records.

iv. Reference Information, such as name and contact details of your references.

v. Social Media Information, such as if you provide us a link to or other access to a social media account, we may collect or access any information you permit to be disclosed through or from your social media account and other information depending on the social media platform.

vi. Employment Eligibility Information, such immigration status, visa or work permit information, government issued identification information and any other information necessary to verify your employment eligibility.

h. Other Information You Provide to Us or Other Third Parties or We Collect Automatically. We may automatically collect information about you, your visit to a Location and/or your use of the Services (collectively, the “Other Information”). Such Other Information may include:

i. From Your Activity. We may collect or receive information regarding:


A. referring and exit pages and URLs;
B. date and time; and
C. details regarding your activity on the Services, such as search queries and other performance and usage data.

ii. About Your Device. We may collect or receive information regarding:
A. type of device;
B. advertising Identifier (“IDFA” or “AdID”);
C. operating system and version;
D. IP address, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or mobile device;

E. browser type and language;

F. carrier; and
G. network type (WiFi, 3G, 4G, LTE).

iii. From Cookies. We may use cookies and similar tracking technologies to collect Information about your browser, device and activity on our Services. Please see our Cookie Policy and our Regional Policy for details.

2. HOW INFORMATION IS USED
Without limiting the foregoing, the purposes for which we may use the Information are as follows:

a. Operate our Business. We may use the Information to operate, manage, secure, and improve our Services, provide our Services and products to you, process your online orders, perform customer service functions, solicit and process your feedback about our Services and products, market and provide personalized advertising to you, ensure the safety and security of our Locations, and conduct analytics on the Services. We may also use Information for performing accounting, and other functions such as internal and external reporting, processing claims, conducting audits, and generating statistics to identify trends and opportunities.

b. Respond to Your Requests. When you contact us, we collect and use the Information necessary to respond to your request and provide you with support. For example, we may collect your name and contact information, payment and rewards program account information, and other details about your request.

c. Conduct Marketing. We use the Information to provide you with personalized advertising and content, and to determine the effectiveness of our marketing campaigns. As further described below in Section 2(i), we may aggregate the Information we collect to develop analysis and business intelligence for marketing purposes.

d. Administer Our Rewards Program. When you enroll in our rewards program or participate in a contest, promotion, survey, or offer, we may collect and use Information in order to administer or fulfill such program or offer.

e. Manage Our Locations. We may monitor and record footage of individuals visiting our Locations by using CCTV, video camera or other visual supervision to ensure security and safety of persons and property, as well as for regulatory purposes.

f. Prevent Fraudulent or Other Criminal Activity. We may use the Information to verify your identity, protect against and prevent fraud and other unlawful activity, unauthorized transactions, investigate incidents, claims and other liabilities, for safety and security purposes, and to manage risk exposure and quality.

g. Meet Legal, Regulatory and Compliance Obligations. We may use the Information to conduct investigations, comply with and enforce applicable legal requirements, relevant industry standards, contractual obligations, and our policies and terms, comply with legal requests and legal processes (e.g., subpoenas and requests from government agencies) and protect and enforce the rights, property, or safety of us or others, including you.

h. Recruit Potential Candidates. We may use the Information to conduct our recruiting activities, including general recruitment management, operate the Nouria Careers site (https://nouria.wd1.myworkdayjobs.com/nec), recruit, interview and evaluate candidates, conduct background checks and other pre-employment screenings, verify employment eligibility, analyze and improve our recruitment process, provide reasonable accommodations for disabilities and health conditions, prepare employment agreements, communicate about opportunities with us and conduct other related business operations.

i. Use of Aggregated Information for Certain Purposes. We and our Services Administrators may aggregate your Information with that of other users of the Services and use, store, analyze and disclose the aggregated Information for any purpose as long as the aggregated Information does not identify you. We or our Services Administrators may disclose and/or license this data to our affiliates, agents, business and promotional partners, and other third parties. We may also disclose aggregated user Information to describe the Services and these products to current and prospective business partners and investors and to other third parties for other lawful purposes.

j. For Other purposes. We may use your Information for any other purposes disclosed to you when you provide Information, at your request, or with your consent.

3. HOW INFORMATION IS DISCLOSED

We may disclose the Information to the recipients and for the purposes described below:


a. Affiliates and Subsidiaries. We may disclose the Information within our group of companies, which includes parents, subsidiaries, affiliates and other entities under common control with us.

b. Service Providers. We may disclose the Information to third party service providers who, among other things, host the Services, provide analytics, assist with customer service, process transactions, provide IT and technical assistance, provide internet services and other infrastructure support, provide identity verification, send out email and SMS communications, provide market research, administer our rewards program, manage promotions and process payment transactions. These service providers will have access to the Information only as necessary to perform their functions.

c. Licensors, Franchisors and Food Vendors. We may disclose the Information to licensors, franchisors and other food vendors that we partner with in one or more of our Locations to provide our products to you, improve your experience and process payment transactions.

d. Promotional and Marketing Partners. In order to provide our Services and other products, and to administer our promotional programs, we may disclose the Information to our third-party promotional and marketing partners, including, without limitation, businesses participating in our various programs. If you opt in to our SMS text programs as set forth in Section 10 below, we will not disclose your phone number to third parties for their direct marketing purposes, though we may disclose your phone number to our service providers as set forth in Section 3(b) above.

e. Law Enforcement or Government Agencies. We may disclose the Information to law enforcement or other government agencies if required to do so by law, regulation, subpoena, court order, warrant or similar legal process, or in good faith belief that such action is necessary to protect and fulfill our legal obligations, defend our rights or property or in urgent circumstances to protect the personal safety of any individual.

f. Potential Acquirers and Corporate Transaction Parties. In connection with a business transaction, we may disclose the Information to third parties in connection with a proposed or actual reorganization, bankruptcy, merger, sale, joint venture, assignment, transfer, license or other disposition of all or any portion of our assets or stock.  

4. ACCESSING AND MODIFYING INFORMATION AND COMMUNICATION PREFERENCES
If you have provided us any Information, you may access, remove, review, and/or make changes to some Information by contacting us as set forth below. In addition, you may manage your receipt of e-mail marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing e-mails. We will use commercially reasonable efforts to process such requests in a timely manner. You cannot opt out of receiving transactional e-mails related to the Services (e.g., requests for support or confirmations of a transaction). We may also deliver notifications to your mobile device (e.g., push notifications). You can disable these notifications by deleting the Nouria App or by changing the settings on your mobile device.

5. HOW WE PROTECT YOUR INFORMATION
We take reasonable organizational, technical, and administrative measures to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties to which we may disclose such Information, nor can we guarantee that the Information you supply will not be intercepted while being transmitted over the internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

6. RETENTION OF INFORMATION
We retain the Information for as long as needed or as otherwise consistent with the purposes for which it was collected. When determining the retention period, we use various criteria, including, the length of time we have an ongoing relationship with you and provide our Services to you, the legitimate business purposes for which we collect and process personal data as described above, and whether we are subject to a legal obligation that requires us to retain records.

7. IMPORTANT NOTICES TO NON-U.S. RESIDENTS
The Services and its servers are operated in the United States. If you are located outside of the United States, please be aware that your Information, including your Contact Information, may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may be different than those in your jurisdiction. If you are located outside the United States and choose to use the Services, you consent to such transfer, processing, and use in the United States and elsewhere.

8. THIRD-PARTY APP STORES; THIRD-PARTY SERVICES; EXTERNAL WEBSITES
We have no control over the collection of Information by third-party services or websites, and any such collection or use will be subject to that third party’s applicable privacy policies. You should review the applicable third-party privacy policy to learn about their privacy practices. For example, your app store (e.g., iTunes or Google Play) may collect certain information in connection with your use of the Nouria App, such as Contact Information, Transactional Information, Geolocational Information, and other usage-based data. The Services may also contain links to third-party websites. When you make a purchase at one of our Locations or sign up for our rewards program, your Information will be processed by our third-party service providers processing the payment or administering the rewards program, subject to their privacy policies.

9. CHILDREN
The Services and our other products are not directed to children under the age of 16. We will not knowingly collect Information from any child under the age of 16. If you are under the age of 16, do not use the Services. If a child under the age of 16 has provided us with Information, a parent or guardian of that child may contact us and request that such Information be deleted from our records.

10. SMS Marketing
If you elect to receive text messages, we will send you recurring text messages regarding your account activity, transaction activity, promotions, and other news and information about us to the mobile number you provided even if your mobile number is registered on any state or federal Do Not Call list. If you do not agree to these terms, do not sign up for text messages. You understand that you do not have to sign up for this program in order to make any purchases, and your consent to this program is not a condition of any purchase with us. Your participation in this program is voluntary. 

Your wireless carrier may assess certain fees or charges associated with your use of text messaging. We are not responsible for such fees. Your carrier may restrict or prohibit certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Our text message program applies only to mobile devices registered in the United States and with United States carriers. Please review your wireless carrier’s policies and contact them if you have any questions. You acknowledge that you are at least eighteen years of age and you have the consent of the wireless account holder to sign up for text messages and pay for any related fees. If you are between the ages of 16-18, you may only sign up for our text messages under the supervision of a parent or guardian and with their consent. We may use an automatic dialing system or automated number selection system to send you text messages. Neither we nor the carriers are liable for any delays or failures in the receipt of any text messages. Delivery is subject to effective transmission from your network operator. You are responsible for updating your number with us and ensuring your account information is correct. Messages may be sent via SMS or MMS messaging. Text messages may be promotional or transactional (in response to your registration for our Services, for example) in nature.

You can cancel our text message alerts at any time by texting “STOP” in response to the text message you received, after which we will send a text message to confirm that you have been unsubscribed. After this exchange, you will no longer receive text messages from that particular number. If you want to receive our text alerts again, text 508-297-9882 (or respond to the unsubscribe confirmation) with START or change the phone number in your account and we will start sending text alerts to you again. If at any time you forget what keywords are supported, text “HELP” to the text message you received and you will receive instructions on how to use our Service as well as how to unsubscribe. If you receive a suspicious or unsolicited text message that claims to be from us, please do not respond to the message, click on any links, or provide any personal information. Please remember that we will never ask for sensitive information, such as passwords, social security numbers or credit card details via a text message. Please contact us as set forth in Section 12 below with any questions regarding our text messages.

11. CHANGES TO THIS PRIVACY POLICY
This Privacy Policy is effective as of the date stated at the bottom of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the Website. By accessing the Services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information. Please refer back to this Privacy Policy on a regular basis.
