Regional Policy for Certain US States 

This Regional Policy for Certain US States (“Regional Policy”) provides additional information to individuals who are residents of certain US states such as Connecticut, Rhode Island and New Hampshire (“Relevant Regions”), as required under applicable data protection laws in those regions (“Regional Laws”). This Regional Policy supplements and is governed by our Privacy Policy. Any capitalized terms not defined in this Regional Policy will have their meaning assigned to them in the Privacy Policy, or if not defined in the Privacy Policy, then under the Regional Laws.

Your Consumer Rights

Certain Regional Laws provide individuals in Relevant Regions with certain rights regarding their Personal Data. If a Regional Law applies to you, you may submit a request to exercise your right(s) in relation to your personal information, as follows:

  • Confirm Processing/Access: You may request to confirm whether we are Processing Personal Data about you and request access to the Personal Data we have collected about you.
  • Correct: You may request that we correct any inaccuracies in the Personal Data we have collected about you, taking into account the nature of the Personal Data and the purposes of the Processing of your Personal Data.
  • Delete: You may request that we delete the Personal Data provided by, or obtained about, you.
  • Data Portability: You may request to obtain a copy of your Personal Data Processed by us, in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another organization without hindrance, where the Processing is carried out by automated means.
  • Opt Out: We may Process your Personal Data for purposes of Targeted Advertising and/or Sale of Personal Data. Under Regional Laws, you may have the right to request to opt out of the Processing of your Personal Data for purposes of: (i) Targeted Advertising, (ii) Sale of Personal Data (subject to applicable exceptions under Regional Laws), or (iii) Profiling in furtherance of solely automated decisions that produce legal or similarly significant effects concerning you, to the extent we conduct these Processing activities.
  • Please note you may designate an authorized agent, acting on your behalf, to opt out of such Processing of your Personal Data, by way of using technology, including, but not limited to, an internet link or a browser setting, browser extension or global device setting, indicating your intent to opt out of such Processing.

Exercising Your Rights

You can usually access, correct, or delete your Personal Data using your account settings and tools that we offer, but if you aren’t able to do that, or you don’t have an account, or you would like to contact us about one of the other rights, our contact information is set forth in Section 13 (HOW TO CONTACT US) of the Privacy Policy. Making a verifiable consumer request does not require you to create an account with us, but we may require you to use an existing account if you have one.

Please note that we may not be able to fulfill your request depending on our legal obligations, and certain exceptions under Relevant Laws may exist that permit us to decline certain requests. For example, we may not be able to delete or anonymize all data as we may be legally required to retain certain data or retain certain data in identifiable form. Or, we may decline to fulfill a request if it would require disclosing a Trade Secret.

Only you or your authorized agent may make a verifiable consumer request related to your Personal Data. If you are a parent or legal guardian of a child, you may also make a verifiable consumer request on behalf of your child. If you are a guardian or conservator of an individual, you may make a verifiable consumer request on behalf of such individual.

Under some Regional Laws, you may only make a verifiable consumer request, free of charge, once during any 12-month period. If your requests are manifestly unfounded, excessive or repetitive, we may charge you a reasonable fee to cover the administrative costs of complying with the request or decline to act on the request.

The verifiable consumer request must (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized agent making the request on your behalf has the authority to do so, (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it, and (iii) contain a statement that identifies yourself as a resident of a Relevant Region, and which Relevant Region. We cannot respond to your request or provide you with Personal Data if we cannot verify your identity, the authority to make a request on your behalf (if request is made by an authorized agent) and confirm the Personal Data relates to you. We will respond to a verifiable consumer request within the time periods permitted under Regional Laws. If we require more time, we will inform you of the reason and extension period in writing, in accordance with Regional Laws. Please note that depending on the nature of your request, we may notify a partner, franchisee, or other third party who may have a direct relationship with you.

Appeals

If we decline to fulfill all or part of your request, we will provide you with the reasons for our decision. If you disagree with our decision or our response to your request, you may appeal by contacting us as set forth in Section 13 (HOW TO CONTACT US) of the Privacy Policy with the reasons you disagree with our decision and any including any supplementary information you wish to provide. You may also contact the Attorney General in your Relevant Region if you have any concerns regarding how we processed your request by visiting the website of the relevant Attorney General’s office or requesting that we provide you with their contact information.  

Regional Notice

If you are a resident of a Relevant Region, Regional Laws require us to disclose the following information with respect to our Processing of your Personal Data.

  • Categories of Personal Data Processed By Us or Shared With Third Parties: For information about the categories of Personal Data Processed by us or shared with third parties, please see Section 1 (PERSONAL INFORMATION WE COLLECT OR RECEIVE) of the Privacy Policy.
  • Purposes for Processing Personal Data: We collect personal information for the purposes described in Section 2 (HOW INFORMATION IS USED) of the Privacy Policy.
  • Categories of Third Parties With Which We Share Personal Data: We may disclose your Personal Data to third parties, as described in Section 3 (HOW INFORMATION IS DISCLOSED) of the Privacy Policy.
