These Nouria Gift Card Terms and Conditions (“Terms and Conditions”) govern your use of the Nouria Energy Corporation (“Nouria”, “we,” “us,” or “our”) plastic Gift Cards and electronic Gift Cards (“Gift Cards”). These Terms and Conditions apply in addition to the Terms of Use and Privacy Policy set forth on the Nouria.com website, which are incorporated herein. Your use of a Gift Card constitutes your acceptance of and agreement to comply with these Terms and Conditions.
IMPORTANT: THESE TERMS AND CONDITIONS CONTAIN A MANDATORY ARBITRATION PROVISION THAT, AS FURTHER SET FORTH BELOW, REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES. THIS MEANS THAT YOU AND NOURIA ARE EACH GIVING UP THE RIGHT TO SUE EACH OTHER IN COURT OR IN CLASS ACTIONS OF ANY KIND. IN ARBITRATION, THERE IS NO JUDGE OR JURY AND THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT.
Purchase, Redemption, Use. Purchases of Gift Cards are final and not refundable. Gift Cards do not expire and there are no fees associated with use of the Gift Cards, unless otherwise specified. The Gift Cards can be applied in full or in part only to purchases of eligible products and services at Nouria stores in the United States or purchases at [www.nouria.com] The balance on any Gift Card is solely the liability of Nouria. Eligible goods and services, and affiliated properties, are subject to change in our sole discretion. We reserve the right to limit quantities of Gift Cards purchased by any person or entity.
Electronic Purchases. You may be required to open an account on the Website to purchase an electronic Gift Card. Recipients of electronic Gift Cards purchased through the Website will be notified by email. To redeem an electronic Gift Card, the recipient must add the electronic Gift Card amount to an existing or newly created User Account. Instructions for creating a User Account and redeeming electronic Gift Cards will be available through the notification email and Website.
Balance Inquiry; Reloads. You may check your balance of the Gift Card at Nouria stores or by phone 877-668-7423.
Limitations. Gift Cards purchased in the United States may be redeemed only in the United States, its territories, and possessions. Gift Cards may not be purchased, redeemed, or used outside the United States. Gift Cards cannot be used for previous purchases, merchandise credits, or the purchase of gift cards or fundraising items. Gift Cards must be presented at the time of purchase, and the available balance will be applied to your purchase. If a purchase exceeds the amount of a Gift Card’s balance, the Gift Card holder must pay the difference using another accepted payment method. You may not consolidate or combine multiple Gift Cards to purchase a new Gift Card. No credit card, credit line, overdraft protection, or deposit account is associated with your Gift Card. Gift Card balances cannot be assigned or transferred. Gift Cards may be used as personal or business gifts but may not be used in connection with any marketing, advertising, or other promotional activities (including without limitation via websites, Internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts). Use of Nouria’s name, logo, trade dress (including any image/likeness of the Gift Cards) or trademarks (or those of any of its subsidiaries or affiliates) in connection with the purchase or use of the Gift Cards is strictly prohibited. The use of Gift Cards in any manner that states or implies that any person, website, business, product, or service is endorsed or sponsored by, or otherwise affiliated with, Nouria or any of its subsidiaries or affiliates is prohibited.
Risk of Loss. Nouria is not responsible for lost or stolen Gift Cards. Risk of loss and title for Gift Cards passes to the purchaser upon receipt of the Gift Card or transfer or electronic transmission to the recipient; for avoidance of doubt, such recipient may not always be you. IF LOST OR STOLEN, THIS CARD CANNOT BE REPLACED. Gift Card is void if copied, altered, transferred, purchased, or sold. We reserve the right to cancel a Gift Card if we believe that the Gift Card was obtained through fraudulent or unauthorized means. Nouria reserves the right to close accounts and/or request alternative forms of payment if a Gift Card is fraudulently obtained or used.
Purchases are Final and Nonrefundable. Purchases of Gift Cards are final and not refundable. Notwithstanding anything contained in these Terms and Conditions, Gift Cards are not returnable or refundable for cash except in states where required by law. We reserve the right to correct the balance of a Gift Card if we believe that a billing error has occurred, and we disclaim all liability for any such billing errors. Resale of Gift Cards is strictly prohibited.
Additional Terms and Privacy. Purchase, redemption, and use of Gift Cards are subject to our Website Terms of Use, Privacy Policy, and other terms or policies in effect at the time, as applicable, and use of the Gift Card constitutes acceptance thereof. Visit https://nouriaenergy.com/privacy-policy/ for information about how we collect, use, and disclose information. We, may disclose to the purchaser of a Gift Card whether or not the recipient has redeemed the Gift Card.
Changes to these Terms and Conditions. These Terms and Conditions are subject to change without notice. If the laws pertaining to a Gift Card require additional or different terms or conditions, then such terms and conditions shall apply. Use of a Gift Card is governed by the laws of the State of Massachusetts.
Compliance with Law. You represent and agree that your purchase and use of the Gift Cards will comply with all applicable laws, rules, and regulations, and that you will not use the Gift Cards for any unlawful purposes. You agree to defend and indemnify Nouria and its subsidiaries and affiliates from and against any claims, expenses, or liabilities made against or incurred by any of them in connection with your use of the Gift Cards and for any violations of these Terms and Conditions.
Exclusion of Warranties and Limitation of Liability. NOURIA ENERGY CORPORATION AND ITS LICENSEES, AFFILIATES, AND LICENSORS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, CREDITS, OR CODES, OR WWW.NOURIA.COM WEBSITE, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT A GIFT CARD, CREDIT OR CODE IS NONFUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD, CREDIT OR CODENOURIA WILL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE GIFT CARDS OR THESE TERMS
AND CONDITIONS, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY IF THESE LAWS APPLY TO YOU. SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES.
Dispute Resolution. Any dispute between you and Nouria involving Gift Cards will be governed in all respects by Massachusetts law, without regard to its or any other jurisdiction’s choice of law provisions, and not by the 1980 U.N. Convention on Contracts for the International Sale of Goods. Except where prohibited by applicable law, and without limitation to any statutory rights for consumers, you agree that all disputes, claims, and legal proceedings directly or indirectly arising out of or relating to the Gift Cards (including purchases made with such Gift Cards) will be resolved individually, without resort to any form of class action, and exclusively in the state or federal courts located in Massachusetts. You consent to waive all defenses of “lack of personal jurisdiction” and “inconvenient forum” with respect to venue and jurisdiction in the state and federal courts of the United States.

CARD FOR PURCHASE–ABBREVIATED TERMS AND CONDITIONS
By purchasing or using a Gift Card (“Card”) you accept the Terms and Conditions. This Card does not expire and there are no fees for using this Card. This Card may be used only for purchases using the available balance at Nouria stores or www.nouria.com. This Card may not be exchanged for cash or credit except where required by law. Get balance information at 877-668-7423. This Card is void if copied, altered, transferred, purchased, or sold. No replacement for lost, stolen or damaged cards. Nouria reserves all rights, without notice to you, to void Cards and purchases if we suspect that Cards have been obtained or used in violation of law.
